This Privacy Policy provides information about what data Mäder & Partner collects and how Mäder & Partner uses and protects the collected data. This applies to personal data that Mäder & Partner processes.

A. Data collection and use

1. Use of the website

You can use the Mäder & Partner website without actively disclosing personal data. The active provision of personal data is not a condition of using the Mäder & Partner website, unless it is necessary for the supply of a desirable service. Nevertheless, in the course of the standard operation of the website, certain data will be automatically or passively collected from you or about you in connection with your visit to the website. In addition, you can actively provide personal data for requesting and receiving information and services etc. by means of various forms. Such personal data is used to fulfill your request (e.g. contact form or customer surveys) and the processing is based on your consent.

With regard to the personal data you provide (e.g. for services requested by you), Mäder & Partner relies on technical and organizational means to ensure compliance with applicable data security regulations.

2. Data collection from business partners and coachees

In the course of our business activities, Mäder & Partner processes personal data of customers, coachees, suppliers and other business partners. These data include:

Data of customers / suppliers and further business partners:

  • First and last name, private address, date of birth, position and title, associated company/job, industry, any cross-connections (e.g. shareholders or related parties), creditworthiness data, references and other background information.
  • Communication with existing, former and potential business partners and third parties
  • Service and billing data, bank details, insurance coverage
  • Documentation and other information related to the business relationship

Coachee data:

  • First and last name
  • Home address
  • Telephone number
  • E-mail address
  • Effective duration until new placement
  • New job found as
  • Occupational field
  • Age and gender
  • Education
  • Information on curriculum vitae such as professional stations, education and training, qualifications, language and computer skills, and references
  • Notes on the counseling interviews
  • Results of personality tests

We collect personal data (also “personal data”) when you provide us with personal data, e.g. when you contact us, submit your application documents, are in a personal conversation with us or work with us as part of our range of services. We also collect personal data that we receive from clients and coachees in the course of our business activities with them and other persons involved, or that we collect from their users when operating our website. We also reserve the right to collect personal data from publicly accessible sources, e.g. from the debt collection register, LinkedIn, the commercial register, other registers, websites or the media.

B. Processing of personal data/transfer of personal data

Mäder & Partner uses personal data primarily to carry out its business activities, e.g. to support coachees in the application process by assessing and revising application documents and responding to inquiries.

Mäder & Partner processes personal data of customers and other business partners for the following purposes:

  • Concluding and processing contracts, documenting, invoicing and improving their services
  • To offer and further develop our offers, services and website
  • Communication
  • Delivery of newsletters, information about the offers of Mäder & Partner, customer surveys, invitations to events, sending of customer gifts and similar information
  • Compliance with legal obligations and internal regulations.
  • Assertion of legal claims and defense in connection with legal disputes and official proceedings

Mäder & Partner processes this personal data of Coachee mainly for the following purposes:

  • Consulting activity
  • Offering and further developing our offers, services and website
  • Support during the application process by assessing and, if necessary, adapting the application documents
  • Communication
  • Delivery of newsletters, information about the offers of Mäder & Partner, customer surveys, invitations to events, sending of customer gifts and similar information.

The personal data collected under section “Data collection” remain with data processors or on servers that act for Mäder & Partner and for which Mäder & Partner is responsible. The personal data collected by Mäder & Partner will not be disclosed in any form, either by Mäder & Partner or by representatives of Mäder & Partner for their own use by third parties, unless this is necessary to fulfill the purpose for which it was collected (e.g. for processing an order), or if Mäder & Partner has received your prior consent or is legally obliged to do so.

In order to provide you with efficient support, it is also possible that your personal data (first and last name and e-mail address) is transmitted to external providers that we involve in order to manage the processes necessary for offering these services (e.g. to IT service providers) or if the service package includes personality tests from subcontractors, as listed here:

  • To maintain our website, we need to provide certain personal data to our hosting provider, Hostpoint, Neue Jonastrasse 60, 8640 Rapperswil-Jona, Switzerland.

Mäder & Partner has entered into an order data processing agreement with all third-party providers to ensure the protection of any other personal data you share on these platforms.

An exception applies with respect to data passively collected from you on Mäder & Partner’s website through third-party cookies and related technologies. Third party providers of such cookies/related technologies may use your personal data for their own purposes and may transfer such data to other jurisdictions (please refer to Mäder & Partner’s Cookie Notice).

Some of this data may be stored on computers or processed at sites located in other jurisdictions whose data protection laws may differ from the jurisdiction in which you live. In particular, you should expect your data to be transferred to any country where the service providers engaged by Mäder & Partner and their subcontractors are located. So far as Mäder & Partner requires a legal basis for the processing of personal data, Mäder & Partner relies on your consent (within the meaning of Art. 6 para. 1 lit. a DSGVO) or Mäder & Partner processes your personal data for the initiation or performance of a contract (within the meaning of Art. 6 para. 1 lit. b DSGVO), to comply with legal requirements (within the meaning of Art. 6 para. 1 lit. c DSGVO) or to protect the legitimate interests of Mäder & Partner or third parties (within the meaning of Art. 6 para. 1 lit. f DSGVO). A legitimate interest lies in particular in fulfilling the purposes described in this privacy policy and being able to implement corresponding measures.

C. Processing of personal data with the use of "Zoom" and "Teams

We would like to inform you below about the processing of personal data in connection with the use of “Zoom” and “Teams”.

“Zoom” is a service of Zoom Video Communications, Inc, 55 Almaden Blvd, Suite 600, San Jose, CA 95113 with an office in EU (Lionheart Squared Ltd, Upper Pembroke Street 28-32, Dublin DO2 EK84, Republic of Ireland).

“Teams” is a service provided by Micorosoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA.

Purpose of processing
We use the “Zoom” and “Teams” tools to conduct conference calls, online meetings, video conferences and/or webinars (hereinafter: “Webinars”). By registering for a webinar, you also agree that your data may be used by Mäder & Partner to contact you.

Person responsible
The responsible party for data processing directly related to the implementation of “Webinars” is Mäder & Partner AG.

Note: Insofar as you access the website of “Zoom” or “Teams”, the provider of “Zoom” or “Teams” is responsible for data processing. Consult the privacy policy of “Zoom” and privacy policy of “Teams”.

What data is processed?
When using “Zoom” or “Teams”, different types of data are processed. In this context, the scope of the data also depends on the information on data you provide before or when participating in a “webinar”.

The following personal data are subject to processing:
User details: first name, last name, telephone (optional), e-mail address, password (if “single sign-on” is not used), profile picture (optional), department (optional).

Meeting metadata: Topic, description (optional), attendee IP addresses, device/hardware information.

For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A file of all audio recordings, text file of online meeting chat.

For dial-in with the telephone: information on the incoming and outgoing call number, country name, start and end time. If necessary, further connection data such as the IP address of the device can be stored.

Text, audio and video data: You may have the opportunity to use the chat, question or survey functions in a “webinar”. To this extent, the text entries you make are processed in order to display them in the “webinar” and, if necessary, to log them. In order to enable the display of video and the playback of audio, the data from the microphone of your terminal device and from any video camera of the terminal device will be processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the “Zoom” or “Teams” applications. In order to participate in a “Webinar” or to enter the “Meeting Room”, you must at least provide information about your name. However, you also have the option to use a pseudo name if you do not want other participants to know your name.

Scope of processing
We use “Zoom” and “Teams” to conduct “webinars.” If we want to record “webinars”, we will transparently tell you in advance and – if necessary – ask for consent. The fact of recording will also be displayed to you in “Zoom” or “Teams”. If it is necessary for the purposes of logging the results of an online meeting, we will log the chat content. However, this will not usually be the case.

If you are registered as a user with “Zoom”, then reports on “webinars” (meeting metadata, telephone dial-in data, questions and answers in webinars, survey function in webinars) may be stored by “Zoom” for up to one month.

Legal basis of data processing
Personal data is processed exclusively within the framework of the applicable legal provisions, in particular the Swiss Data Protection Act (DSG) and, where applicable, the European Data Protection Regulation (DSGVO).

Recipients / passing on of data
Personal data processed in connection with participation in “Webinars” will not be passed on to third parties.

Other recipients: The provider of “Zoom” or “Teams” necessarily obtains knowledge of the above-mentioned data insofar as this is necessary for the purpose of conducting “Webinars” (privacy policy of “Zoom” or privacy policy of “Teams”).

D. Security

Mäder & Partner uses technical and organizational security measures in order to protect your personal data against manipulation, loss, destruction or access by unauthorized persons. The security precautions of Mäder & Partner are constantly revised and improved based on the new state of the art.

E. Right of access, rectification, erasure or restriction of processing, right to object to processing, right to data portability

Subject to the data protection laws applicable to you, you have the right to request from the controller (1) information and (2) rectification or (3) erasure of your personal data or (4) restriction of the processing of your personal data, and you may object (5) to the processing of your personal data. In addition, you have (6) a right to data portability.

Simply send an email to the controller of your data admin@maederundpartner.ch or contact the controller at the address provided in the “Contact Details” section. The data controller will process these requests in accordance with the applicable data protection law and may also refuse or restrict them in accordance with the legal regulations.

F. Right to withdraw consent at any time

You have the right to revoke your consent to the future processing of your personal data at any time. However, for the sake of clarity, this revocation does not affect the lawfulness of the processing based on the consent given prior to the revocation.

Note that exercising this right of withdrawal may conflict with contractual arrangements and may have consequences such as early termination of the contract or cost consequences. The responsible party will inform you about such consequences in advance, where this is not already contractually regulated.

G. Data retention

Mäder & Partner stores personal data for as long as required by the purposes pursued with the processing, the legal retention periods and the legitimate interests of the processing for documentation and evidence purposes, or as long as storage is technically necessary. Documentation and evidence purposes include Mäder & Partner’s interest in documenting processes, interactions and other facts in case of legal claims, discrepancies, for IT and infrastructure security purposes and as evidence of good corporate governance and compliance. Retention may be technically required if certain data cannot be separated from other data and therefore must be retained with it (e.g., in the case of backups or document management systems). With regard to data passively collected from you, please also refer to Mäder & Partner’s information on cookies.

Mäder & Partner undertakes to carefully store the documents provided for the purpose of consulting services and to protect them against inspection by third parties. At the latest 3 months after completion of the consulting activity, the documents (application documents, meeting notes, personality test evaluations) will be deleted immediately. The following personal data will continue to be stored for marketing purposes (invitation events, newsletters, customer gifts, annual statistics):

Coachees can request information about and deletion of their personal data free of charge at any time.

Status reports, if client company: The responsible HR contact person receives structured feedback from us at six-week intervals on the status of the consultation on a data protection basis.
