This Privacy Policy applies to all data processing in connection with the use of our website, collaboration with candidates, collaboration with employers and clients, as well as collaboration with business partners and external service providers.

Almost every time you interact with us, personal data is processed. Personal data means all information relating to an identified or identifiable natural person.

Depending on the group of persons, we process different categories of personal data, as listed below:

• user and identification data (e.g. automatically generated user ID, login ID)
• master and contact data (e.g. title, surname, first name, postal address, gender, telephone number, e-mail address, date of birth)
• career and application data (e.g. curriculum vitae, references and diplomas, professional background, qualifications and skills, career goals and preferences, results of personality tests, assessments and evaluations)
• communication data (e.g. e-mail correspondence, conversation notes, feedback)
• placement data (e.g. contacts with potential employers, placement activities)
• technical data (e.g. IP address, usage data from digital tools)

Most of the data is provided to us voluntarily by you, in particular in the context of our collaboration or when you contact us.

We may collect personal data not only directly from you, but also from third parties, in particular from client companies, commissioning parties, reference persons or other persons. Where necessary and permissible, we may also obtain personal data from publicly accessible sources, in particular from professional networks (e.g. LinkedIn), from the commercial register, from websites or from the media.

We process your data only to the extent that this is appropriate and necessary for the provision and development of our services.

• For candidates:
  We process personal data for the provision of New Placement, outplacement and coaching services, in particular for career counselling, the creation and optimisation of application documents, preparation for application processes, the performance of assessments, communication and placement with potential employers. For candidates with a client login, we also process personal data to provide our services in the client area. After the collaboration has ended, we may contact former candidates as part of our alumni network, in particular to promote professional exchange, provide information about alumni activities or events, or maintain contact with the professional network. Participation in the alumni network is voluntary; unsubscribing is possible at any time and in a simple manner. For further marketing measures, in particular the sending of newsletters or general advertising communication, we use personal data only if the corresponding consent has been given. This consent may be withdrawn at any time with effect for the future.

• For client companies:
  We process personal data for the initiation, performance and management of our business relationships, for mandate management, invoicing, communication and quality assurance of our services.

• For business partners:
  We process personal data for collaboration, contract management, communication and the organisation of our services.

• For visitors to our website:
  We process technical data for the provision and security of our website.

• For applicants:
  We process personal data of applicants for a position at Mäder & Partner exclusively for the purpose of conducting the application process and assessing possible employment. This includes, in particular, reviewing the application and qualifications, communication during the application process, conducting interviews, obtaining references (only where permissible or with the applicant’s consent), deciding whether to establish an employment relationship and fulfilling legal obligations in connection with application procedures. Application documents are made accessible only to those persons involved in the application process. If employment is established, the application documents required for the employment relationship are transferred to the personnel file. If no employment relationship is established, we delete or destroy the application documents after completion of the application process, unless statutory retention obligations apply or the applicant has expressly consented to longer retention. The applicant may withdraw their application at any time.

We make this Privacy Policy available to data subjects in an appropriate manner, in particular by publishing it on our website and, where necessary or appropriate, by providing a link or a copy at the beginning of the collaboration or at the time of data collection.

Where data processing is not necessary for the performance of a contract, we rely on our legitimate interests, in particular in the efficient organisation and provision of our services, the documentation of our services, the maintenance of our professional network, quality assurance, the further development of our services, and the assertion and defence of legal claims.

We disclose personal data only to the extent that this is necessary for the relevant group of persons in order to provide our services, manage business relationships or comply with legal obligations.

5.1 External service providers and companies
In the course of our activities, data may be disclosed in particular to external service providers and processors, especially in the areas of IT infrastructure, hosting, communication, data management, assessments, personality tests, digital tools and platforms, marketing and analytics. This also includes specialised providers who support us in carrying out assessments (e.g. personality tests or similar suitability assessments). We may also use digital tools and platforms to support our services (e.g. for data analysis, matching and process support through specialised recruiting or AI based applications). In addition, personal data may be disclosed to partner agencies (including freelancers), potential employers, client companies and network partners, insofar as this serves professional positioning. Furthermore, we may provide candidates with access to external career and learning platforms (e.g. Choice Career Center). For this purpose, e-mail addresses and, where applicable, other contact details required for registration may be transmitted to the respective platform provider. The use of such platforms is exclusively for the purpose of supporting professional reorientation and career development.

5.2 Social media
Our website may contain links to external platforms, in particular social media services. If you use such services or access corresponding content, data may be transmitted to the respective providers. We have no influence over data processing by these third-party providers. Please refer to the respective privacy policies of these providers for further information.

5.3 Communication and office applications
In our communication and collaboration, we may also use digital services such as e-mail systems, video conferencing solutions or office applications. Mäder & Partner uses, in particular, Zoom and MS Outlook as well as other Office 365 applications from Microsoft, such as Word, Excel, Outlook, Teams and PowerPoint. This may involve the processing of personal data by the respective providers. Where possible and appropriate, we refrain from using cloud based services. Further information on data protection at Zoom and Microsoft, e.g. which data is transmitted, how it is used and which measures are taken in the event of transfer abroad, particularly to the USA (e.g. encryption, data processing agreements, standard contractual clauses, data protection impact assessment, certifications), can be found in the data protection information provided by Zoom and Microsoft. Please note that such measures can partially compensate for weaker or lacking statutory protection abroad, but they cannot completely exclude all risks, for example government access abroad.

5.4 Authorities and other third parties
Finally, personal data may be disclosed to authorities, courts or other public bodies in Switzerland and abroad if we are legally obliged to do so or if there is a corresponding legitimate interest.

Where a company or employer finances or commissions our services, appropriate information on the status of the counselling may be provided to that company or employer within the scope of the mandate. This is done in the form of structured status reports and is limited to the information required for the performance and management of the mandate.

Other data recipients may include, for example, service providers (e.g. IT providers), dealers, suppliers, subcontractors, business partners, clients, media, visitors to websites and social media, competitors, associations, organisations, acquirers or interested parties in business units, or other parties in legal proceedings.

Mäder & Partner maintains servers in Swiss data centres, on which your data and the information required to provide our services are securely stored and processed.

By using our website and services and by receiving this Privacy Policy, you generally consent to the collection, storage, processing and transmission of data to third parties (if necessary also abroad) within the framework of appropriateness and necessity.

As part of the services provided by Mäder & Partner and the provision of the website and its content, data is generally transferred abroad only under the conditions set out in section 5. If a recipient is located in a country without an adequate level of data protection, we make efforts to contractually oblige the recipient to comply with the applicable data protection requirements (e.g. data processing agreements, standard contractual clauses), unless the recipient is already subject to a legally recognised framework to ensure data protection and we cannot rely on an exception.

Data security is of the highest priority for us. We undertake to handle documents entrusted to us with care and to protect them through appropriate technical and organisational measures. We therefore also process personal data for security purposes, in particular to ensure the security of our IT systems and IT infrastructure, to prevent misuse and for evidentiary purposes.

Mäder & Partner takes a wide range of technical and organisational measures to appropriately safeguard the security of your data and to protect it against unauthorised or unlawful processing, loss, accidental alteration, unintended disclosure or unauthorised access. However, certain residual risks remain unavoidable.

Depending on the system, data category and risk, technical and organisational security measures include, in particular, access restrictions based on the need-to-know principle, role based authorisations, multi-factor authentication, encryption, logging, firewalls, protection against malware, regular system updates, and the creation and secure storage of backups. Organisational security measures also include, for example, instructions to our employees regarding data protection, confidentiality agreements and controls. Existing security measures are reviewed as part of ongoing IT support and adjusted where necessary. Where possible and appropriate, personal data is used in anonymised or pseudonymised form, in particular for statistical evaluations, for the further development of our website, content and services, for the review and optimisation of internal processes, and for the training and further training of our employees.

Our IT systems and infrastructure are provided by selected cloud and IT service providers. Appropriate technical and organisational measures are implemented to protect the confidentiality, integrity and availability of the systems and data. Technical maintenance, administration and support are provided by a Swiss IT service provider.

Mäder & Partner uses and stores your data only for as long as this is necessary for the relevant processing purposes, another legal basis exists, or we have a legitimate interest in doing so.

Data that we hold on the basis of a contractual relationship with you is retained at least for as long as the contractual relationship exists and limitation periods for possible claims by us are running, or statutory or contractual retention obligations exist. For most data, a ten-year retention period applies in this respect (e.g. for contracts and invoices).

Candidate documents (e.g. application documents, results of personality tests, conversation notes), on the other hand, are deleted no later than three months after the end of the contractual relationship, and status reports at the end of the following financial year, unless statutory or contractual retention obligations prevent this.

Mäder & Partner is entitled to anonymise the data in order to store and continue to use it for archiving or statistical purposes and for the evaluation and improvement of our website, content and services.

Prompts and outputs when using Mäder & Partner’s AI applications are stored only for as long as necessary.

In connection with the data we process about you, you have the following rights:

9.1 Right of access
Within the legal framework, you have the right to obtain information from us within a reasonable period of time and, in principle, free of charge, as to whether and which data we process about you. In the event of abusive access requests, we reserve the right to charge for these.

You can ask us to correct or complete incorrect or incomplete data about you in our systems. Where technically possible and where no statutory retention obligations prevent this, you may also request the deletion or anonymisation of your data.

9.3 Right to restriction or objection
You have the right to request that we restrict the processing of your data. You may request restriction of the processing of your data if you dispute the accuracy of this data, if the processing is unlawful, if the data is no longer required, or if you object to the processing.

If the processing of the data is restricted, the data may only be stored. Further processing may only take place with your consent, for the establishment, exercise or defence of legal claims, for the protection of the rights of another person, or for reasons of important public interest.

9.4 Right to data disclosure and transfer
You have the right to receive the data concerning you, which is based on consent, on a contract or on processing by automated means, in a structured, commonly used and machine readable format, and to transmit this data to a third party.

Where technically feasible, you may request direct transmission to a third party. The rights and freedoms of other persons must not be adversely affected by this.

You generally have the option of lodging a complaint with the competent supervisory authority regarding these data processing activities. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

9.6 Restrictions
Please note that these rights may be restricted or excluded in individual cases, for example if there are doubts about your identity or if this is necessary to protect other persons, to safeguard legitimate interests or to comply with legal obligations.

The exercise of these rights may also conflict with contractual agreements and may have consequences such as premature termination of the contract or cost implications.
